What is the survivor's pension percentage?

The percentage of the deceased's pension due to survivors is: 60% to spouse alone; 70% to one child alone; 80% to spouse + 1 child; 100% to spouse + 2 or more children. Siblings and parents are entitled to 15% each if there is no spouse or children.

Does the survivor's pension stop if I remarry?

No. The survivor's pension is not lost upon remarriage (rule changed in 1987). The survivor retains the right to the pension even if they enter into a new marriage.

Does a divorced former spouse have the right to the survivor's pension?

Yes, but only if they were receiving alimony at the time of death and have not remarried. The survivor's pension share is apportioned between the new spouse and the former spouse, taking into account the duration of their respective marriages.

Survivor's pension

The survivor's pension is due to the spouse (or former spouse receiving alimony), dependent children and, in their absence, other relatives (parents, siblings), upon the death of a pensioner. If the deceased was still working (not yet retired), this is called an indirect pension. The application must be submitted to INPS within 5 years of death (prescription period).

Step-by-step procedure

Check entitlement to the survivor's pension

The survivor's pension is due to: the surviving spouse (even if separated, not if divorced without alimony), dependent minor or disabled adult children, student children up to age 26 if dependent. The former spouse with alimony has the right to a share, in competition with any new surviving spouse.

The survivor's pension may be reduced if the beneficiary has other income (thresholds vary each year).

Submit the application to INPS

Log in to inps.it with SPID or CIE. Go to Benefits and services > Survivor's pension (or indirect pension) and complete the online form. Alternatively, contact a patronage office (CAF, INCA, ACLI) which submits the application for free. State your IBAN for payment.

The survivor's pension is backdated to the month following the death, regardless of when the application is submitted (within the 5-year prescription period).

Wait for payment

INPS processes the application in 30-60 days. The first payment includes arrears from the month following the death. The pension is credited monthly to the beneficiary's account.
