Can both parents take it at the same time?

Yes, since 2022 both parents can take parental leave at the same time (even for the same child), each for their own days.

Is it also available for adopted children?

Yes. For adopted or foster children, parental leave is available within 12 years of the child's entry into the family, regardless of the child's age (up to 18 years).

Are self-employed workers entitled to parental leave?

Yes, but with different rules and amounts. Those enrolled in the INPS Gestione Separata are entitled to 3 months of parental leave within 12 years of the child's birth, with an allowance of 80% of the reference income.

Parental leave

Parental leave is optional and available to both parents who are employees (self-employed: different rules). Each parent is entitled to a maximum of 6 months, for a combined total of no more than 11 months per couple (the father can take one extra month if he takes at least 3 months). It can be used until the child is 12 (or 12 years from adoption/fostering). The allowance is 30% of salary, except the first month which from 2025 is paid at 80%.

Step-by-step procedure

Notify your employer

Before applying to INPS, notify your employer with the required notice: 15 days for periods longer than 15 days, 5 days for daily use. The employer cannot deny parental leave but can ask to postpone the start date for organisational reasons (maximum 1 month delay).

Submit the application to INPS

Log in to inps.it with SPID or CIE. Go to Benefits and services > Parental leave and complete the application. State the requested period, the form of use (continuous, split by days or hours) and the child's details. You can delegate a patronage office for free.

Leave can be split into days or, if the collective agreement allows, even hours.

Receive the allowance

For private sector employees: the employer advances the allowance in the payslip and recovers it from INPS. For public sector employees: INPS pays directly. The allowance is 30% of the average daily wage for all periods, except the first month for each parent which from 2025 is paid at 80%.
